The first step in our process is the evaluation phase.

STEP 1 – EVALUATION

What happens during the evaluation phase? Evaluation is the first step in any legal process and it is where it is determined whether you have a claim. Our experts will look at the facts and consider whether another person’s irresponsible conduct caused your loss.

The two most common types of misconduct, that can support a claim, are negligence and intentional misconduct.

Negligence is the most common situation present in personal injury situations. The law holds individuals responsible for their own carelessness. For example, a driver who neglects to stop for a stop sign or a doctor who fail to follow established medical protocols are being negligent.

Intentional misconduct means exactly what it says, someone is intentionally misbehaving. This is when someone purposely does something that causes injury or loss to another person. In this situation, the person understands what they are doing is misconduct, it is intentional.
